These Web sites, SPPKids.com and SPPSPORTS.com are owned and operated by SportsProfilesPlus, Inc. ("SPP") subsidiary of Profile Network Inc. SSP is collecting personally identifiable information ("PII") and will have the use of PII submitted to this site in accordance with the terms of this Privacy Policy.
This Privacy Policy describes how SPP, uses and shares PII and other "non-PII" information obtained from and about individuals, including children, on this site. From time to time, we may revise this Privacy Policy to reflect changes in the law, self-regulatory practices, new technology, and/or features of the site. Therefore, all users, including parents and their children, should review this Privacy Policy periodically so they are up to date on our most current policies and practices. We are committed to providing and maintaining a safe and secure environment on the Internet for all users, including children. The Internet presents a unique opportunity for us to reach our audience in new and exciting ways with programming information, fun games, exciting sweepstakes and contests, shopping and auctions (but we will not knowingly permit children to participate in shopping and auctions without parental consent or supervision) and other forms of interactivity.
Our Philosophy: We believe that we can provide an exciting and entertaining experience for users without requiring them to submit more than a minimal amount of PII. Most activities for users on our site can be performed without the participant supplying PII. Instead users may be asked to provide such non-PII as first name, age, gender, city, and/or state of residence. In those instances where we do request PII, parents can be confident that it will be collected and maintained in accordance with all federal and state laws, including the Children's Online Privacy Protection Act ("COPPA"). In addition, we never require anyone, including children, to disclose more PII than is reasonably necessary for them to participate in an activity.
Collection of Your Personal Identifiable Information ("PII") and Other Personal Information: Currently, no registration or input of PII is required just to visit the site. Registration or input of PII may be required to participate in e-commerce, sweepstakes, contests and promotional activities. From time to time, we may also ask you to provide us with non-PII information, such as your age, zip code, first name, or state or residence. This information does not allow us to identify you by email address, full name or full address, and we use this information for internal purposes, or for creating reports for ourselves and third party advertisers and partners. Such reports might read, for example: "25,000 users clicked on the banner ad, and of those who clicked, 40% were over the age of 25, and 20% lived in California." We may use PII for an adult entry in a sweepstakes, contest or promotional activity to notify you that you are a winner, for prize delivery and to ensure that we comply with all applicable laws. We will inform you at the time we are collecting the PII that such collection is a requirement of entering the sweepstakes or contest, and allow you the option of not participating.
Purchases from our sites require disclosure of credit card information and information about the name and address of the person receiving the purchases. Credit card information may be subject to verification by the issuing Credit Card Company or other company. Sales and shipping records will also be maintained. Unless you give us permission at the time we collect such information, however, we will not use this information for any purpose except as described above to fulfill the purchase order.
We may also collect PII at other times, for example, through user surveys; but this information will not be used for any purpose other than as disclosed when you submit it, and will be subject to the "opt-out" procedures described below. Children under 13 cannot participate in these surveys. When we collect PII from you, we will give you the opportunity to "opt-out" of allowing us to use your PII for other purposes. If you do not "opt-out", we may use your PII for the following purposes: (1) personalize and enhance our site; (2) send personalized information about our site to you via email, (3) send you advertising or promotional material from us, our advertisers or business partners; (4) provide your PII to our business partners for their use in advertising or marketing; (5) contact you for feedback regarding us, our advertisers or business partners via email surveys.
Unless you have "opted-out" as described above, we may also use your PII to provide a report to our advertisers or business partners that tells them who responded to a particular offer. For example, we might send you an email that offers you a discount on a particular item or service. If you click on that email or accept an offer or discount contained in it, we may provide the advertiser or business partner with the PII necessary to provide you with that discount.
If you "opt-out" as described above, we may still use your PII for internal purposes, or as may be necessary to administer the site or comply with applicable law. If you opt-out, SPP will not use your PII to send you emails or advertising, nor will we share your PII with third parties, except for their respective successors and assigns or as otherwise stated in this Policy. If you shop on these sites, you hereby represent to SPPKIDS.COM and SPPSPORTS.COM that you are over the age of 18, and may enter into a binding contract in your jurisdiction of residence. It is your responsibility to maintain the confidentiality of your account, password and to restrict access to your computer and email address. You also agree to accept all responsibility for activities that occur under your account, email address or password. SPPSPORTS.COM and SPPKIDS.COM does sell products for children, however we sell them only to individuals over the age of 18 who can legally purchase with a credit card. SPPSPORTS.COM and SPPKIDS.COM reserves the right to refuse service, terminate accounts, remove or edit content, and cancel orders at its sole discretion. SPPSPORTS.COM and SPPKIDS.COM will not be liable for any orders placed, or site registration, that incorporates fraudulent, falsified or stolen information.
Administering the Site and Compliance with Law: SportsProfilesPlus may disclose your personally identifiable information if we believe in good faith that we are required to do so in order to comply with applicable law, a subpoena, or other legal process. SportsProfilesPlus may also use such information when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating our Terms of Service or to protect the safety of our users and the public. In addition, SportsProfilesPlus may disclose such information for administrative and other purposes that we believe are necessary to develop, maintain and improve our products and services.
In addition, we may share your personal information under confidentiality agreements with certain third parties which assist us in developing, operating and maintaining SportsProfilesPlus. Such disclosure will be pursuant to confidentiality agreements
Special Rules for Children's Personal Identifiable Information ("PII")
General: We do not share any PII provided by children between the ages of 13 and 18 with any third parties unless otherwise stated at the point of collection of such information and subject to "opt out." As required by COPPA, we will not share PII of children under 13 with any third parties.
Contests and Sweepstakes: When the site allows children under 13 to participate in contests and sweepstakes, we collect a child's email address for the sole purpose of communicating with the participating child on a one-time basis, should he or she become a potential winner. Before any prize is sent out, or a child is declared a winner, he or she, together with a parent or guardian, must sign and return the affidavit of eligibility and release form (the "Release") contained in the email the winner receives. If the Release is not returned to us within the time period noted, the prize is forfeited and an alternate winner is chosen. We never use these email addresses to contact a potential winner a second time and we delete all email addresses collected once the contest or sweepstakes is over. Sometimes, however, the name and address (city and state) must be provided in a winners' list, by law. You should review any applicable sweepstakes and promotional rules or user agreements, as noted on the website, prior to entry.
Submissions: We may have areas of the Web site that request the submission of creative content from users via mail or fax. At the point of such a request, we will ask the user to print out a release form from the site. If the user is a child under 13, then the child and his or her parent or legal guardian must sign and return the form on his or her behalf with any such submission as a prerequisite to consideration of such creative material.
Requests for Feedback: We may request feedback from users, for example, regarding an activity, piece of content or regarding merchandise offered or purchased on the site by an adult or by a child who purchased with adult consent and/or supervision. Such feedback is used for internal purposes only and any PII that is accidentally submitted is deleted. Such feedback helps us in our quest to provide the most compelling activities, content and selection.
Safety and Security: If you share your computer or use a computer that is accessed by the general public (a University Library, etc.) remember to sign off and close your browser window when you have finished your session. This will help to ensure that others cannot access your personal information.
We take steps to help ensure that all information provided by you, whether PII or non-PII, is treated securely. Unfortunately, no data transmission over the Internet can be guaranteed totally secure. As a result, while we strive to protect your personal information, we cannot guarantee the security of any information you transmit to us. You use the site, and provide us with personal information, at your own risk. To the extent reasonably necessary to protect a user's safety, we may collect his or her name, address, and/or email address, and when the user is a child under 13 the address or email of his or her parent. Prior to using a child's information, we will send his or her parent an email informing him or her that: (a) we have collected the child's name, address and email address to protect his or her safety; (b) the parent may refuse to permit the use of the information and require us to delete it; and (c) if the parent fails to respond within 24 hours, we may use this information for the purposes outlined in this policy.
To protect our security, to protect us against liability, or as required by law, we may collect a user's name and email address. PII collected pursuant to this provision will not be used for any other purpose.
Our Use of Cookies: We use cookies to track unique visitors to our site. However, we do not use cookies to collect or otherwise record any type of PII provided by or about any visitor to our site. We use cookies to track who has used what areas of the site. We may also use cookies to track non-PII information about users to the site, such as age or zip code, to allow us to create reports for internal use, and use by third parties. For example, we might use cookies to help us create a report that "25,000 people clicked on this link, and of those people, 50% participated in a contest and, of them, 60% were above the age of 25."
Many computers and computer programs contain features that allow you to block or refuse to accept such cookies. Use of such features may prevent you from being able to access certain portions of the site, or access certain features.
Co-Branded Micro Sites: Web pages and/or micro Web sites included within our site may be co-branded with third party names, logos, and/or properties, and are operated and maintained by us. Banner Advertisements: We may include banner advertisements for third parties (or for sites operated by third parties) that are not sponsors of (and are not affiliated with) our Web site. As such, we are not responsible for the content, practices, or information practices of the Web sites operated by these third parties. In addition, these banner advertisements do not constitute sponsorship, endorsement, or approval by us of the content, policies, or practices of these Web sites. All users, including children and their parents, should check the relevant Web site's privacy policy and terms of use in order to understand their policies and practices regarding the collection and use of PII. We will always display a "bumper" page to notify users, including children and their parents, when they are leaving our site.
Affiliated Companies: We may include links to Web sites operated by various family friendly companies, or their successors or assigns. We may obtain information collected on such Web sites; however, this Privacy Policy will apply to any such PII we obtain in this manner. Visitors to such Web sites should still look at the privacy policies of such Web sites before providing them with any PII. We encourage you to read the privacy polices of these other companies/sites and to contact these companies/sites directly if you have any questions about their use of this information.
Review and Deletion of Personal Information: All users may review their PII at any time. Parents may review and delete their child's, or their own, PII in our records at any time. If you would like to review or delete this information, we will use all reasonable efforts to comply with your requests. Please contact us at the address or email below. Please note that if a parent does not permit us to use or collect PII, or if the parent has instructed us to delete PII, a child's participation in those activities for which the PII has been requested may not be possible.
